Illinois Revises Biometric Law

The Illinois Government has amended its Biometric Information Privacy Act (BIPA) to significantly reduce financial penalties for companies that misuse biometric data. Previously, companies could face damages of $1,000 for each negligent violation and $5,000 for each intentional or reckless violation. The new amendment, effective as of August 2, consolidates multiple violations involving the same individual into a single violation, thus limiting recovery to a maximum of one instance per person.

This change aims to lower potential settlements and reduce the financial impact on companies while aligning with broader trends in privacy law reform. The amendment also introduces e-signatures as valid for consent, reflecting a shift toward more manageable regulatory requirements in the digital age.
