Digital Economy Liability Rules

The EU has updated its product liability rules to reflect the growing digital features of products and the circular economy. The new rules explicitly cover products like software, AI systems, and product-related digital services. These changes benefit both consumers and manufacturers, making it easier for consumers to claim damages and providing clear rules for digital products. The rules also promote harmonization across the EU.

The updated rules ensure that there is always an economic operator within the EU from whom a victim can claim compensation, even for products manufactured outside the EU. This provision also applies to products sold through online platforms. The EU prioritizes product safety, with laws ensuring that all goods sold within the EU meet stringent safety, health, and environmental standards. The General Product Safety Directive establishes specific obligations for businesses to ensure consumer product safety.
